Terms and Conditions

Welcome to Gourmet Palates, LLC ("Gourmet Palates," "we," "us," or "our"). These Terms and Conditions govern your access to and use of our website [www.gourmetpalatescle.com] (the "Site") and the purchase of products and services offered through the Site. By accessing or using the Site, you agree to comply with and be bound by these Terms and Conditions.

1. Use of the Site
 

You may use the Site only for lawful purposes and in accordance with these Terms and Conditions. You agree not to:

  • Use the Site in any way that violates any applicable law or regulation.

  • Engage in any activity that interferes with or disrupts the Site or its servers.

  • Attempt to gain unauthorized access to the Site, accounts, computer systems, or networks connected to the Site.

  • Use any data mining, robots, or similar data gathering or extraction methods.
     

2. Products and Services
 

We offer a variety of catering products and services through the Site, including charcuterie and grazing boards and related accessories. All purchases made through the Site are subject to availability and our return policy.

 

3. Orders

When you place an order through the Site, you agree to provide accurate and complete information. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing or product descriptions, or suspected fraud.

All orders must be placed no less than 14 days in advance, with confirmation. Orders placed under 14 days are subject to our discretion. Additional fees may be applicable.

Deposits and Payments

​

All orders are subject to a deposit of no less than 50% of the order cost. Payment for orders must be made through our designated payment processor. By providing payment information, you represent and warrant that you have the legal right to use the payment method provided.

Cancellation Policy

​

Cancellations with less than 72 hours notice are 100% non-refundable & non-creditable.

Cancellations within 7 days are subject to 25% of the original deposit.

4. Delivery

We will deliver products to the address specified in your order. We offer a flat rate delivery fee of $25.00 up to 25 miles of 44123; further deliveries will be charged $2/per additional mile.

We will deliver directly to the ordering client at the designated address, or if otherwise directed, a designated partner. If the ordering party is deemed unavailable, the board will be dropped off at the ordering address. We are not responsible for the order past this point. The order, once it is dropped off, is solely the client's responsibility. By placing the order for delivery, the client agrees to these terms.

5. Rentables

​

Any rentable items are exclusively on loan and must be returned to Gourmet Palates, LLC within 24 hours of the last day of the order. We will arrange a direct pick-up between a representative and the client.

Damage to rentables and/or items provided for events OR failure to return all rentable items will result in a penalty fee of $200.00.

5. Returns and Refunds

​

6. Intellectual Property
 

The Site and its contents, including but not limited to text, graphics, logos, images, and software, are owned by Gourmet Palates, LLC or its licensors and are protected by copyright and other intellectual property laws.

 

7. Disclaimer of Warranties

THE SITE AND ALL PRODUCTS AND SERVICES OFFERED THROUGH THE SITE ARE PROVIDED "AS IS" AND WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8. Food Safety Compliance Statement

Our charcuterie boards are prepared and handled in accordance with established food safety protocols and guidelines. We source our ingredients from reputable suppliers and take meticulous care in the storage, handling, and presentation of our products to ensure their freshness, quality, and safety.

We are dedicated to ongoing education and training to stay updated on the latest food safety practices and regulations. Additionally, we adhere to all local, state, and federal regulations governing food handling, preparation, and sanitation.

9. Limitation of Liability

IN NO EVENT SHALL GOURMET PALATES, LLC (ITS EMPLOYEES, OR AGENTS) BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR PRODUCTS PURCHASED THROUGH THE SITE.

10. Governing Law

​

These Terms and Conditions shall be governed by and construed in accordance with the laws of Cuyahoga County, Ohio, without regard to its conflict of laws principles.

11. Changes to Terms and Conditions

​

We reserve the right to update or change these Terms and Conditions at any time. Any changes will be effective immediately upon posting the revised Terms and Conditions on the Site. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms and Conditions.
